Terms and Conditions
for the iOS app “LUME – Voice Diary”
1. Scope
These Terms and Conditions apply to the use of the iOS app “LUME – Voice Diary”, hereinafter referred to as the “App” or “LUME”.
The website lume-diary.com is provided solely for informational purposes regarding the App and is not part of the paid App services.
These Terms apply to all users of the App. Any deviating terms of users shall not apply.

This email address may be used for support requests, legal requests, privacy requests and other communications.
3. Apple App Store, Apple Standard EULA and Apple’s Role
The App is made available through the Apple App Store. The applicable terms of the Apple App Store, including Apple’s Standard EULA, apply in addition insofar as they are applicable to the use of the App.
The contract regarding the use of the App is concluded between you and the Provider. Apple is not the provider of the App services.
To the extent subscriptions or other App Store-related processes are concluded or managed through the Apple App Store, purchase processing, subscription management, cancellation and any refunds are handled in accordance with Apple’s terms and procedures.
4. Requirements for Use and Minimum Age
The App may be used by persons aged 13 years and above.
Users under the age of 18 may enter into paid subscriptions only with the consent of their legal guardians.
Use of the App requires a compatible iOS device and an active internet connection.
5. User Account and Registration
Use of the App requires the creation of a user account.
During onboarding, you will be asked to provide your name and email address in order to create a user account.
You are obliged to provide accurate information during registration and to keep your login credentials confidential. You are responsible for protecting access to your device and your user account against unauthorized access.
The Provider may offer additional login or registration methods in the future.
6. Description of the App Services
LUME – Voice Diary is an iOS app for personal journaling and self-reflection.
The App enables, in particular:
- creating journal entries from voice input,
- AI-assisted transcription and conversion of voice input into editable journal entries,
- adding photos to journal entries,
- selecting a mood, for example by choosing an emoji,
- a calendar or entry overview,
- displaying simple usage progress, such as a streak for consecutive days with entries,
- optional AI-assisted reflection questions for saved entries.
The App is intended exclusively for your private, personal use.
7. Free Use, Trial Access and LUME Pro
The Provider may grant users time-limited free access to certain App functions without a subscription being concluded. This access ends automatically and does not renew as a paid subscription.
After a free access period has expired, the recording function may be restricted or blocked. Entries already created remain accessible, provided you do not delete your user account.
LUME Pro enables extended use without the restrictions of the free version. Use is subject to fair, customary and non-abusive use.
Where a free subscription trial period is offered through the Apple App Store, it will be displayed to you before the subscription is concluded. After the trial period ends, the subscription converts into a paid subscription unless it is cancelled in time through Apple.
8. Prices, Subscription, Automatic Renewal and Cancellation
The following LUME Pro subscriptions are currently offered:
- monthly subscription: EUR 7.99
- annual subscription: EUR 49.99
The prices shown to you before concluding the subscription in the Apple App Store or within the App are decisive.
LUME Pro subscriptions automatically renew for the selected term unless they are cancelled in time through Apple’s subscription management. The cancellation period and the exact time by which cancellation must occur are governed by Apple’s applicable terms.
Deleting the App or your user account does not automatically terminate an active subscription. A subscription must be cancelled separately through Apple’s subscription management.
After a subscription expires or is cancelled, the recording function may be restricted or blocked. Entries, photos and other stored content already created remain accessible, provided you do not delete your user account.
9. Withdrawal and Refunds for Apple Purchases
Consumers may have statutory withdrawal rights.
To the extent a subscription is concluded through the Apple App Store, purchase processing, cancellation, withdrawal and any refunds are handled in accordance with Apple’s terms and procedures.
The Provider has no access to your payment data and cannot directly refund payments processed through Apple.
10. Rights of Use in the App
The Provider grants you a simple, non-exclusive, non-transferable and revocable right to use the App on your devices for your private, personal use.
The App and its software, design, trademarks, logos, texts, functions and other content are protected by copyright, trademark law or other rights and remain with the Provider or its licensors.
You may not copy, modify, reverse engineer, decompile, redistribute, make publicly available, commercially use or use the App to develop a competing product, unless this is mandatorily permitted by law or expressly approved by the Provider.
11. Rights in User Content
You retain all rights to your content to which you are entitled.
In order for LUME to provide the App functions, you grant the Provider a simple, non-exclusive, non-transferable right, limited to the duration of use, to technically store, process, display, transcribe, convert into journal entries and create related reflection questions from your content.
This right serves exclusively to provide the App.
The Provider does not use your journal entries, voice recordings, photos or other content to train its own AI models.
The Provider does not publish your content and does not use it for marketing purposes unless you have expressly consented to this.
12. Voice Recordings, Journal Entries, Photos and Reflection Questions
Voice recordings are processed only for transcription and creation of a journal entry and are not permanently stored as audio files. Once processing is complete, it is not possible to listen to the original voice recording again.
The App may create a draft journal entry from your voice input. You may review and edit this draft before saving it. The journal entry is saved only when you actively save it.
Where provided in the App, you may add photos to your journal entries. The Provider may technically limit or restrict the use of photo attachments within the scope of fair, customary and non-abusive use, in particular to ensure the stability, security or economic viability of the service.
Upon request, the App may create AI-assisted reflection questions for an entry after it has been saved. These questions relate to the relevant entry and serve exclusively as prompts for personal self-reflection. You are not obliged to answer or use them.
13. AI Functions
LUME uses AI-assisted functions to transcribe voice input, create journal entries from it and provide reflection questions.
The results are generated automatically and may be incomplete, inaccurate, unsuitable or misleading. You are responsible for reviewing and, where necessary, editing AI-generated drafts and content before saving them.
AI-generated content and reflection questions do not constitute medical, psychological, therapeutic, legal, financial or other professional advice.
The AI functions are intended for customary, private and non-abusive use. The Provider may restrict, suspend or block the use of AI functions if use significantly exceeds customary use, is automated, circumvents technical safeguards or is abusive.
In the event of justified suspicion of abuse or urgent security risks, a restriction may also occur without prior notice.
14. Health Notice / No Advice
LUME is intended for personal journaling and self-reflection.
The App is not a medical device and is not a health, therapy or crisis application. It does not replace medical, psychological or therapeutic advice, diagnosis or treatment.
The App does not automatically analyze your mental state and does not provide medical, psychological or therapeutic recommendations.
If you are in an acute crisis, are thinking about self-harm or suicide, or if there is a danger to you or others, please immediately contact emergency services or a suitable medical, psychological or other qualified professional service.
15. User Obligations and Prohibited Use
You are responsible for the content you enter, upload or store in the App.
You may not use the App to create, store or process illegal content or to infringe third-party rights. This applies in particular to content that is criminal, infringes personality rights, copyrights, data protection rights or other third-party rights.
You may also not use the App to:
- use it abusively or unlawfully,
- scrape or use it in an automated manner,
- circumvent technical safeguards,
- disrupt or impair the operation of the App,
- search for, exploit or disseminate security vulnerabilities,
- use it to develop, improve or market a competing product,
- use it commercially, professionally or institutionally, in particular to provide your own services to third parties.
16. Suspension, Restriction and Termination by the Provider
The Provider may restrict, suspend or terminate access to the App, individual functions or a user account if there is an objective reason.
An objective reason exists in particular in the event of:
- violations of these Terms,
- abusive or unlawful use,
- automated use or circumvention of usage limits,
- technical attacks or security risks,
- infringement of third-party rights,
- significant exceeding of fair and customary use,
- permanent inactivity,
- discontinuation or material change of the service.
In cases of serious violations, suspected abuse or urgent security risks, restriction, suspension or termination may also occur without prior notice.
Where possible and reasonable, the Provider will appropriately take the user’s interests into account.
17. Technical Requirements, Internet Connection and Updates
Certain App functions require an active internet connection. You are responsible for data, mobile network or roaming costs.
You are responsible for keeping your device, operating system and access to the App secure. Jailbreaking or comparable modifications to the operating system are discouraged, as they may impair the security and functionality of the App.
Continued use of the App may require installing available updates. Older App versions may be restricted or no longer supported for technical, security-related, legal or functional reasons.
The App may provide optional push notifications, for example to remind you to use the App. Push notifications are sent only if you activate them or grant the relevant permission. You can disable push notifications at any time in your device settings.
18. Availability, Third-Party Providers and Discontinuation of the App
The Provider endeavors to provide the App reliably, but does not owe any specific availability or specific support response times.
The availability and functionality of the App may depend on third parties, in particular Apple, hosting providers, database services, AI service providers, analytics and security services, as well as internet and mobile network providers.
To provide individual App functions, the Provider uses technical service providers and third parties, in particular for hosting, storage, authentication, AI-assisted transcription and text conversion, subscription management, app distribution, payment processing, push notifications, as well as technical analytics and security. Details on the processing of personal data and the service providers used can be found in the Privacy Policy.
The Provider may modify, replace, restrict or discontinue the App or individual functions in whole or in part for technical, economic, legal or security-related reasons. To the extent this materially affects ongoing paid services, the Provider will inform affected users with reasonable notice, where possible and reasonable.
19. Defect Rights for Digital Products
Consumers have the statutory defect rights for digital products.
The Provider provides the required updates during the relevant period of use to the extent required by law.
Statutory rights remain unaffected.
20. Liability
The Provider is liable without limitation if damage was caused intentionally or by gross negligence, as well as for damages resulting from injury to life, body or health.
In cases of simple negligence, the Provider is liable only if a material contractual obligation has been breached. Material contractual obligations are obligations whose fulfilment enables the proper use of the App in the first place and on whose compliance you may regularly rely. In this case, liability is limited to the typically foreseeable damage.
In all other respects, liability for simple negligence is excluded. Mandatory statutory liability, in particular under the German Product Liability Act, remains unaffected.
21. Account Deletion and Deletion of Individual Content
You may delete individual content created by you within the App, provided the App offers a corresponding function.
If you delete a journal entry, the associated content, in particular photos and reflection questions, will also be deleted. Deletion is final; recovery is not possible.
If you delete your user account, your content stored in the App, in particular journal entries, voice recordings, transcripts, photos and AI-generated content, will be deleted or marked for deletion. Recovery is generally not possible thereafter.
Statutory retention obligations as well as technically necessary backup, billing, security or evidence data remain unaffected.
An active subscription is not automatically terminated by deleting the user account and must be cancelled separately through Apple.
A general export function is currently not part of the App service.
22. Changes to the App and the Terms
The Provider may further develop, modify, expand, replace or restrict the App, in particular for technical, legal, security-related, economic or product-related reasons.
Paid core services of LUME Pro will not be arbitrarily or unreasonably deteriorated.
The Provider may amend these Terms if there is an objective reason, in particular changes in the legal situation, technical changes, new or changed App functions or changes to App Store requirements.
You will be informed of material changes in good time and in an appropriate manner. To the extent a change materially affects your contractual rights, it will become effective only with your consent.
23. Privacy
Information on the processing of personal data can be found in our Privacy Policy.
The Privacy Policy is a separate document and is not part of these Terms.
24. Consumer Dispute Resolution
The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
25. Applicable Law, Jurisdiction and Language Versions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory legal provisions of the country in which they have their habitual residence.
Statutory places of jurisdiction remain unaffected.
These Terms are provided in German and English. In the event of discrepancies between the language versions, the German version shall prevail to the extent legally permissible.
26. Final Provisions
If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.
The statutory provisions shall apply in place of the invalid provision.
